WHEREAS, the Town of Waterloo has long ago reduced the number of Town Justices from two to one; and
WHEREAS, Town Law §20 permits the Town of Waterloo to have two Town Justices; and
WHEREAS, New York State Town Law §60-a empowers this Town Board to restore the office of Town Justice that was previously reduced so that the Town of Waterloo has two Town Justices.
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Waterloo deems it will be in the best interests of the town for the Town of Waterloo to restore the office of Town Justice that was previously reduced so that the Town of Waterloo has two Town Justices; and be it further
RESOLVED that, pursuant to the authority granted by New York State Town Law §60-a, the office of Town Justice that was previously reduced is hereby restored so that the Town of Waterloo has two Town Justices, and be it further
RESOLVED, that this Resolution is subject to a permissive referendum as provided in Town Law §60-a and, therefore, will not take effect until thirty days after its adoption or, if a petition meeting the requirements of Town Law Article 7 is filed with the Town Clerk within thirty days after its adoption, until approved by the affirmative vote of a majority of the qualified electors of the Town voting on such proposition for its approval; and be it further
RESOLVED, that, pursuant to Town Law §60-a, should this resolution take effect, the election of the town justice to the restored office shall take place at the biennial town election next succeeding the effective date of this resolution, for a four-year term of office commencing January first following the election.
